Terms of Service

1. Acceptance of Terms

By downloading or using RealPic, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Description of Service

RealPic is a photo verification service that uses device attestation and cryptographic proof to verify the authenticity of photos. The service includes the iOS app, this website, and the verification infrastructure.

3. Eligibility and Age Requirements

RealPic is not directed at children under 13. You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you may only use the service with the consent of a parent or legal guardian. We do not knowingly collect personal information from children under 13, and if we learn that we have, we will delete it.

4. Verification Threshold

RealPic assigns an internal AI certainty score to each photo. A photo is considered “verified” and displayed as such when its certainty score is 80% or higher and it has not been flagged by RealPic's review process. Photos below that threshold, or that have been flagged, are shown with an authenticity concern notice. The certainty score itself is an internal signal and is not shown to viewers.

Verification is a technical signal about photo provenance, not a legal attestation. Verified status does not constitute evidence admissible in legal, insurance, journalistic, or other adjudicative proceedings. RealPic disclaims all liability for any decision, claim, or reliance made on the basis of a photo's verification status. Users and viewers should not treat verification as proof of any fact depicted in a photo, including but not limited to identity, location, time, or events.

5. Acceptable Use

You agree not to upload, share, or otherwise use the service to distribute:

• Illegal, harmful, or abusive content
• Child sexual abuse material (CSAM)
• Content depicting or promoting violence, self-harm, or harassment
• Sexually explicit content
• Non-consensual intimate imagery, including intimate images shared without the consent of the person depicted
• Content that infringes intellectual property rights
• Spam, scams, or fraudulent content
• Content that impersonates another person or entity
• Content that violates applicable law in any jurisdiction

You also agree not to:

• Attempt to circumvent or reverse-engineer the verification system
• Use automated tools to access the service without our prior written permission
• Misrepresent the authenticity of photos you share

We reserve the right to remove any content and suspend or terminate any account at our sole discretion, with or without notice, for violations of these terms. We also reserve the right to preserve, review, and disclose any user content, metadata, and account information to NCMEC, law enforcement, and other authorities when required by law, valid legal process, or when we believe in good faith that disclosure is necessary to comply with our legal obligations or to protect the rights, safety, or property of RealPic, our users, or the public.

6. Reporting Violations

You can report content that violates these terms through any of the following channels:

• The in-app report button, accessible from any photo view in the RealPic iOS app
• The report link on the public verification page for any RealPic verification URL or QR code

Reports involving child safety are prioritized for immediate review. Reports of apparent child sexual abuse material will be forwarded to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by United States federal law (18 U.S.C. § 2258A).

7. Content Ownership

You retain ownership of photos you capture and upload. By using RealPic, you grant us a worldwide, non-exclusive, royalty-free license to store, process, transmit, display, and create derivative works (including thumbnails, optimized formats, and cryptographic hashes) of your photos as necessary to provide and operate the service, including making photos accessible to anyone who has your verification code or link. This license continues for the duration of your account and, with respect to derivative artifacts (hashes, condensed and thumbnail versions, audit logs, and content preserved for legal compliance), survives account deletion.

8. Subscription and Billing

RealPic Premium is available as an auto-renewing subscription offered in monthly and annual periods. A Premium subscription includes indefinite original photo storage, extended verification features, and any additional capabilities described on our pricing page at the time of purchase.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings after purchase.
• If a free trial is offered, any unused portion of the free trial period is forfeited when you purchase a subscription to that publication during the free trial period.
• Refunds are handled through Apple's standard refund policy. We reserve the right to change pricing with reasonable notice.

Your use of Premium is also subject to our Privacy Policy and Apple's standard end-user license agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the service at any time with reasonable notice. For Free plan users, original photo storage is limited to 30 days as described in our pricing. After that, condensed and thumbnail versions of the photo will still be stored and verifiable.

10. Account Termination and Deletion

You may delete your account at any time from within the app (Settings → Account → Delete Account) or by contacting us at help@realpic.io. Account deletion removes your profile, photos, and personal information from our active systems within 30 days.

Some data may be retained after deletion as required by law or for legitimate business purposes, including cryptographic hashes used to prevent re-upload of content we have removed for policy violations, audit logs used for security investigations, financial records retained for tax and accounting compliance, and content preserved pursuant to a legal hold, law enforcement request, or CyberTipline report obligation under 18 U.S.C. § 2258A (which requires retention for a minimum of one year).

We may suspend or terminate accounts that violate these terms, with or without notice. If we terminate your account for cause, we may retain your content and account data as needed for investigation, legal compliance, or cooperation with law enforcement.

11. Copyright Complaints (DMCA)

We respond to valid notices of claimed infringement under the Digital Millennium Copyright Act. Send takedown notices and counter-notifications to our designated copyright agent at legal@realpic.io. Please include “DMCA” in the subject line of your email so we can route and respond to it promptly.

Our full takedown and counter-notification procedures, the designated agent's registered contact information, and the specific elements each notice must include under 17 U.S.C. § 512(c)(3)(A) and § 512(g)(3) are set out in our DMCA Policy.

RealPic will terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We track takedown strikes against each account and terminate accounts when the pattern of infringement warrants it, as determined by our review.

12. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind. While our cryptographic verification system is designed to be reliable, we do not warrant that it is infallible or that the service will be error-free.

13. Limitation of Liability

To the maximum extent permitted by law, RealPic shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

14. Indemnification

You agree to indemnify, defend, and hold harmless RealPic LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: your content; your violation of these terms; your violation of any law or third-party right; or your misuse of the service.

15. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You and RealPic agree that the exclusive jurisdiction and venue for any dispute arising out of or related to these terms or the service shall be the state and federal courts located in New York, and you consent to personal jurisdiction in those courts.

Any dispute will be resolved on an individual basis. You waive any right to participate in a class action, collective action, or representative proceeding against RealPic.

16. Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these terms by reference and describes how we collect, use, and protect your information.

17. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

18. Miscellaneous

Severability. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement. These terms, together with the Privacy Policy and any additional terms presented at the point of sale or at the time you use a specific feature, constitute the entire agreement between you and RealPic regarding the service.

No Waiver. Our failure to enforce any provision of these terms is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
